However, when River's Bend was developed, the setbacks were five feet and
he assumed the setbacks for Amber Ridge would be the same. He has since found out the
setbacks' are 10 feet.

Zoning Administrator Frolik stated that River's Bend was also supposed to have 10 yard
setbacks, :It was a mistake; a carryover from Flintwood Hills.

Mr, Emmerich stated that most communities require only a five feet setback.

City Engineer Jankowski stated that if the City of Ramsey is going to change to less than
10 feet, the ordinance should be amended so it becomes the standard.

Ms. Frolik stated that the Building Official has expressed a concern about the garage wall
being on the drainage and easement line.

Mr. Emmerich stated that he requires all the lot surveys to have setback stakes.

Ms. Frolik questioned how this type of situation would be handled until the ordinance is
amended.

City Attorney Goodrich stated that to grant a minor variance, a public hearing would have
to held with the Board of Adjustment and the time frame would be about three weeks.

Mr. Emmerich stated they have a "Streets of Reality" home show scheduled for August 16,
1993 so time ia a concern. He inquired if a variance could be granted for the model homes.

Motion by Councilmember Peterson and seconded by Councilmember Hardin to add a case
to tonight's agenda to discuss the possible change of side yard set backs from 10 feet to
five feet.

City Council/May 25, 1993
