<br />Councilmember Olson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-10-271 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0811 TO DENY A REQUEST TO REZONE <br />CERTAIN PROPERTY FROM B-2 BUSINESS TO PLANNED UNIT DEVELOPMENT <br /> <br />WHEREAS, the City received an application to rezone certain property in accordance with <br />Section 9.03.03 (Zoning Amendments) and 920.31 (Planned Unit Development) of the Ramsey City <br />Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That DPM Investments, hereinafter referred to as "Applicant," has properly applied to rezone certain <br />property from B-2 Business to Planned Unit Development (PUD). <br /> <br />2. That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of the City <br />Code on September 7,2006 and said public hearing was properly advertised, and the minutes of said <br />public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />Lot 3, Block 4, Riverside West, Anoka County, Minnesota, according to the recorded plat <br />thereof and that part of Lot 1, Block 1, Riverview Bowl, Anoka County, Minnesota <br />according to the recorded plat thereof lying southerly of the westerly extension of the north <br />line of Lot 2, Block 1, said plat of Riverview Bowl. <br /> <br />4. That the total area of the property to be rezoned is 1.1 acres in size. <br /> <br />5. That the development will include 6 twinhome units. <br /> <br />6. That the proposed rezoning is located within the Metropolitan Urban Service Area (MUSA) <br />boundary. <br /> <br />7. That the Subject Property is currently zoned B-2 Business and the surrounding properties are zoned <br />B-2 Business and R-I Residential. <br /> <br />8. That the SubjectProperty is located within the Mississippi River Overlay District. <br /> <br />9. That the City is in the process of considering revised standards for the Mississippi River Overlay <br />District, which will require new development to be processed as a Planned Unit Development. <br /> <br />10. That the City Code requires Planned Unit Developments to contain 50% private or 20% public open <br />space. <br /> <br />11. That the submitted plan includes 65% private open space. <br />
