Councilmember Elvig introduced the following resolution and moved for its adoption: RESOLUTION #07-10-290 A RESOLUTION ADOPTING FINDINGS OF FACT #0815 RELATING TO A REQUEST FROM MARY TOSO FOR A HOME OCCUPATION PERMIT TO OPERATE A BED AND BREAKFAST ON THE PROPERTY LOCATED AT 7822 142ND AVE NW. WHEREAS, the City of Ramsey received an application froni Mary Toso for a home occupation permit to establish a Bed and Breakfast within the principal dwelling on the property generally known as 7822 142nd Ave NW and legally described as follows: Lot 8, Block 3 Alpaca Estates 2nd Addition, Anoka County, Minnesota, subject to easement as shown on plat (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. That on September 4, 2007, Mary Toso, herein after referred to as "Applicant", properly applied for a home occupation permit to establish and operate a bed and breakfast in her home. 2. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.05 of the City Code on October 4, 2007, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject Property is zoned R-l Single Family Residential. 4. That the Subject Property is a single family lot. 5. That bed and breakfasts are not a permitted use in the R-l Single Family Residential District. 6. That the Applicant has provided documentation to support that the home occupation will be conducted within the private dwelling on the property, that the area set aside for the home occupation does not exceed 20% of the total floor area of the private dwelling, and the operation will not include any employment of persons not residing in the private dwelling in the performance of the home occupation. 7. That the Applicant will reside at the location of the proposed home occupation.
