State law, requires the City to examine "...if the evidence presented by the petitioners, <br />proposers, and other persons otherwise known to the RGU demonstrates that, because of the <br />nature or location of the proposed project, the project may have the potential for significant <br />environmental effects." The City Council is required to adopt findings of fact with regard to <br />the factual and legal reasons for reaching its conclusion about whether or not an EAW will be <br />needed. <br />Staff Recommendation: <br />Due to the nature of the surrounding land uses, (Critical River Corridor, Scenic and Wildlife <br />Corridor, MNRRA, a national park, Mississippi West Regional Park) it can be assumed that <br />there are significant environmental resources in close proximity to the site. However, it is <br />unclear what these resources are and the effect that the proposed activities would have on the <br />resources. Staff is requesting that the City Council consider enlisting the expertise of a <br />consultant to conduct limited research with regard to the items listed in the petition, and ask <br />them to bring forward a recommendation in memo format regarding the need to complete an <br />EAW. - <br />Funding Source: <br />A determination will need to be made with regard to the funding source for the work <br />associated with gathering evidence to make a decision on whether or not an EAW is needed. <br />Typically, EAW documents are paid for by the applicant/developer. A general inquiry with <br />Bolten and Menk Engineering and SRF Consulting and suggested that an environmental scan <br />and professional recommendation would cost around $1,900.00 to 5,000.00 respectively. <br />Council Motion: <br />Motion to direct staff to engage the services of a consultant (at a cost not to exceed <br />to put together a professional recommendation on whether or not a full EAW is warranted. <br />Review Checklist: <br />City Attorney <br />Associate Planner <br />City Administrator <br />CC 11.29.07 <br />—1.00— <br />
