Commissioner Brauer reentered the meeting at 8:40 p.m. Commissioner Levine did not think they should deny this because they do not know the impact this will have on the area. He thought they should have a trial run to find out what the impact will be. Commissioner Trites Rolle stated she was struggling with this because she was unable to come to a really good conclusion to how this fits. Commissioner Levine thought this met the criteria but they did not know what the impact would be. Chairperson Nixt did not feel it met the land use because it was not desi ned to allow op a race trac r and it was not intended to be an outdoor event area. He wondered Grae from wanting to expand the events in the future. Commissioner Van Scoy thought the concept of some of these events is fantastic. He thought there were places for that to happen and he did not think this was the place. He did not think this fit the surrounding area. He stated he would not support this. Chairperson Nixt stated he was not for this based on the lack of information. Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to recommend that City Council adopt findings of fact unfavorable to the applicants request relating to the request for an amended Conditional Use Permit for Diamonds Sports Bar based primarily on the lack of data to support the sound issue related to the motor cross events. Reword Finding 9 to read "does not intend to—and the applicant desires to avoid the nece ssity of obtaining individual special event permi Finding 10 to read "... an "L10 " :' Findings 13, 14 and 15, will be detrimental, will impair enjoyment, will not be harmonious with intended character, and will be disturbing. Finding 17 will be served by adequate facilities, Finding 18 will not create excessive and Finding 19 will because of the noise fumes and dust. Motion Carried.
