Anoka County Contract No. 2007 -0604 <br />JOINT POWERS AGREEMENT <br />FOR THE JURISDICTIONAL CHANGE AND REHABILITATION OF <br />COUNTY ROAD 63 (173RD AVENUE /175TH AVENUE) FROM <br />COUNTY STATE AID HIGHWAY 83 (BAUGH STREET) TO <br />COUNTY STATE AID HIGHWAY 5 (NOWTHEN BLVD.) <br />(CP 08- 10 -63) <br />This Agreement is made and entered into this day of , 2007, <br />by and between the County of Anoka, State of Minnesota, a political subdivision of the State of <br />Minnesota, 2100 Third. Avenue North, Anoka, Minnesota, 55303, hereinafter referred to as <br />"County," and the City of Ramsey, a municipal corporation under the laws of the State of <br />Minnesota, 7550 Sunwood Drive NW, Ramsey, MN 55303, hereinafter referred to as the "City." <br />WITNESSETH <br />WHEREAS, pursuant to Minnesota Statute, Section 163.11, the parties to this agreement <br />consider it mutually desirable to have the County revoke the county road status of a part of CR 63 <br />(173rd Avenue /175th Avenue) located between CSAH No. 83 and CSAH No. 5, and have the same <br />revert to the City as a city street ( "CR 63 Reversion "); and, <br />WHEREAS, the County agrees to fund the rehabilitation of the CR 63 Reversion in <br />exchange for removing the road from the County jurisdiction; and, <br />WHEREAS, the Anoka County Highway Department has prepared preliminary plans for the <br />rehabilitation 'of the CR 63 Reversion, which plans are attached hereto as Exhibit A; and <br />WHEREAS, Minnesota Statute 471.59 authorizes political subdivisions of the State to enter <br />into joint powers agreements for the joint exercise of powers common to each; and <br />WHEREAS, Minnesota Statute 163.11 describes powers related to highways, including the <br />revocation of county roads to cities. <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br />I. PURPOSE <br />The parties have joined together for the purpose of jurisdictional changes to the CR 63 <br />Reversion and the rehabilitation of the CR 63 Reversion as described in Exhibit A. <br />Il. METHOD <br />A. The County shall revoke the County road status of the CR 63 Reversion as <br />provided by law. <br />-231- <br />
