CASE # A <br />Public Hearing <br />REQUEST FOR EASEMENT VACATION FOR TERRACE HILL APARTMENTS; <br />CASE OF TRIDENT DEVELOPMENT, LLC <br />By: Breanne Dalnes, Associate Planner and Steve Jankowski, City Engineer <br />Background: <br />Trident Development, LLC has made an application to vacate a portion of a drainage and utility <br />easement that encumbers part of the property located at 14320 Dysprosium Street (Lot 1, Block 1, THE <br />PONDS OF RAMSEY). The easement was dedicated when The Ponds development was approved in <br />2002. Now that Terrace Hill Apartments has received site plan approval, some revisions are needed to <br />the easement boundary. <br />The following items are included for your information: <br />a) Site location map <br />b) Exhibit of underlying easements to be vacated <br />C) Proposed ordinance <br />Notification: <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet of the <br />subject property of the public hearing to vacate easements. <br />Observations: <br />As part of the approval for the Terrace Hill. Apartments site plan, a revised grading and drainage plan <br />was approved for Lot 1, Block 1, The Ponds of Ramsey. This included the construction and relocation of <br />stormwater capacity to a new pond on the southwest corner of the site. This new pond was sized to <br />accommodate additional capacity from the existing pond on the northern end of the property. The <br />purpose of relocating the stormwater capacity from the northern pond to the southern pond was to enable <br />the new building to be positioned as far north as possible, to avoid impacting potential right -of -way <br />needed for the possible realignment of Highway 47. <br />Funding Source: <br />All costs of easement vacation review are the developer's responsibility. <br />Staff Recommendation: <br />Staff recommends the easement be vacated, contingent upon recording the new easement. <br />—93- <br />
