<br />Councilmember Look introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #07-07-158 <br /> <br />RESOLUTION AUTHORIZING DISMISSAL OF AN EMINENT DOMAIN PROCEEDING <br /> <br />WHEREAS, by Resolution No. 06-05-141 dated May 1,2006 (the "2006 Resolution") the City <br />authorized the commencement of an eminent domain action to acquire a parcel of land in the City for <br />purposes of commercial development and furtherance of the City's goals and objectives for <br />Development District No.1 and as further described in the 2006 Resolution; and <br /> <br />WHEREAS, pursuant to the 2006 Resolution, on May 3, 2006 the City commenced an <br />.eminent domain action in Anoka County District Court for purposes of acquiring the property <br />described in the 2006 Resolution (the "Subject Property"); and <br /> <br />WHEREAS, the title. of the eminent domain action commenced is: <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br /> <br />DISTRICT COURT <br />TENTH JUDICIAL DISTRICT <br /> <br />--------------------------------------------------------------------------------------------------- <br /> <br />City of Ramsey, a Minnesota <br />Municipal corporation, <br /> <br />Case Type: Condemnation <br /> <br />Petitioner, <br /> <br />Court File No. C7 -06-4642 <br /> <br />vs. <br /> <br />North Maple Holdings, LLC, <br />a Minnesota limited liability company, et al. <br /> <br />Respondents. <br /> <br />---------------------------------------------------------------------------------------------------- <br /> <br />WHEREAS, the Anoka County District Court after a hearing on August 25, 2006 found that <br />the City demonstrated that the taking was necessary to serve a public purpose as required by Minn. <br />Stat. Chapter S 11 7; and <br /> <br />WHEREAS, subsequent to the Court's finding of public purpose and approval of the City's <br />Petition, the City entered into preliminary negotiations and agreements with well recognized regional <br />and national developers for development of the Subject Property; and <br /> <br />WHEREAS, the developers referenced above were unable to obtain the commitment of any <br />major large format retailers to locate. within the Subject Property, which type retailer was deemed <br />necessary for the success of the commercial development of the Subject Property; and <br /> <br />WHEREAS, the City itself negotiated directly with a major big box retailer to solicit a <br />commitment to locate within the Subject Property, which direct negotiation was unsuccessful; and <br /> <br />WHEREAS, after considerable discussion in closed attorney-client meetings, the City Council <br />has concluded that it is unable to successfully achieve the public purpose of a redevelopment program <br />
