<br />stated that Oakwood Development is requesting an additional $80,615.05, which is a 92% <br />increase in the anticipated payment. He stated that John Peterson signed the development <br />agreement and the trail has been completed. He stated that he would like the authority to <br />negotiate with Oakwood Development to pay somewhere between the development agreement <br />amount and the amount being asked for. He suggested that in the future, language be included in <br />the development agreement to state clearly what the City will pay for trail reimbursement. <br /> <br />Chair Elvig stated he feels the City will set a precedent if it approves reimbursing for the higher <br />costs. He stated that developers review things with a fine tooth comb and for them to come to <br />the City after the fact and say, "Oops, this cost us more, now reimburse us," is not acceptable. <br /> <br />Councilmember Dehen stated that he is of the philosophy, ask not, get not, but asked if the trees <br />that needed to be removed were visible. <br /> <br />Public Works Director Olson confirmed that the trees were visible. <br /> <br />Councilmember Dehen stated that he feels that the developer should have seen the trees and <br />factored their removal into the bid. He stated that he is not in favor of negotiating with the <br />developer. <br /> <br />Councilmember Olson stated that she was also not in favor of entering into negotiations. She <br />stated that this is an experienced developer that knows how to bid ajob. <br /> <br />Motion by Councilmember Dehen, seconded by Councilmember Olson, to recommend that the <br />City Council deny the request by Oakwood Land Development, Inc. for additional <br />reimbursement for Brookfield Trail. <br /> <br />Motion carried. Voting Yes: Chairperson Elvig, Councilmembers Dehen and Olson. Voting <br />No: None. <br /> <br />Case #5 <br /> <br />Consider Rum River Hills Golf Course Drainage Improvements <br /> <br />Civil Engineer Leonard Linton stated that residents around the Rum River Hills Golf Course had <br />reported problems with water levels back in 2005. He stated that the City completed a drainage <br />study at that time and found that the water backing up on the golf course had no impact on the <br />neighborhood. He stated that some survey work was done in March of 2007 and also looked at <br />again last week and they found that the top of the outlet pipe is 6 inches higher than the low point <br />of the pond. He stated that the area near the maintenance shed is what tends to flood. He stated <br />that the City purchased a drainage and utility easement when this project was developed because <br />the intent was that there would be water from off the golf course site coming across onto the site. <br /> <br />Councilmember Dehen asked who installed the outlet pipe too high. <br /> <br />Civil Engineer Linton stated that the City has been unable to find the set of plans for the pipe, but <br />noted that the City did not install the pipe. <br /> <br />Public Works Committee /October 16, 2007 <br />Page 9 of 12 <br />
