Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #07-12- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RELIABLE AUTO COLLISION EXPERTS, DBA BLUE LINE COLLISION TO CONDUCT INDOOR VEHICLE REPAIR IN THE E-l EMPLOYMENT DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Reliable Auto Collision Experts, DBA Blue Line Collision, hereinafter referred to as the "Permittee" has properly applied for a Conditional Use Permit to conduct indoor vehicle repair on the property legally described as follows: Auditor's Subdivision No. 96, Lot 11 ("Subject Property") WHEREAS, the Planning Commission met on December 6, 2007, conducted the public hearing and recommended City Council approval/denial of the request, with contingencies. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact #_, a Conditional Use Permit ("Permit") to conduct indoor vehicle repair is hereby granted to the Permittee. 2. This Permit only allows vehicle repairs to take place within the building located on the Subject Property. 3. No vehicle storage or display is permitted in front of the building. 4. Only vehicles awaiting repair may be stored behind the building, storage of parts or cannibalized vehicles is not permitted. 5. A new opaque, maintenance-free fence will be installed around the entire rear yard to screen damaged vehicles from view on the adjacent public streets. 6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. 7. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this Pennit. 8. That the City Administrator, or his/her designee, shall have the right to inspect the premises for compliance and safety purposes annually or at any time, upon reasonable request. 8
