Councilmember -moved for the adoption of the following resolution: <br />RESOLUTION #07-12- <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FOR <br />A CONDITIONAL USE PERMIT AMENDMENT TO ALLOW MOTOCROSS, SNOWMOBILE <br />RACING, DEMOLITION DERBY, AND RODEOS <br />WHEREAS, Diamonds Sports Bar & Grill, Inc., hereinafter referred to as "Applicant", has <br />properly applied for a Conditional Use Permit Amendment to allow motocross, snowmobile racing, <br />demolition derby, music events, and rodeos on the subject property generally known as 7550 Highway <br />#10, legally described as: <br />Lot 1, Block 1, The Diamonds, Anolca County, Minnesota <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY; STATE OF MINNESOTA that the findings of fact relating to the <br />request are determined to be as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on October 4`h, 2007 and that said public hearing was <br />properly advertised. <br />2. Than the City Council and Plamung Commission held a worksession on October 30, 2007 to discuss <br />the applicant's request, discussed the options for a trial period (Interim Use Permit), and directed <br />Staff to conduct a sound trial with regard to motocross racing. <br />3. The public hearing was continued to November 1, 2007, and the minutes of said public hearing are <br />hereby incorporated by reference. <br />4. That on November 1, 2007 the Planning Commission met, and recommended denial of the <br />Conditional Use Permit, based on the unknown effects the additional sound .would have on the area. <br />5. That the Subject Property is located in the B-2 Highway Business District and is approximately 16.6 <br />acres in size. <br />6. That Section 9.20.22 (B-2 Business District) of City Code pernlits outdoor commercial recreation <br />- with the issuance of a conditional use permit. <br />7. That the parcels adjacent to the Subject Property to the south and east are part of the Mississippi <br />West Regional Park; the property to the west of the Subject Property is zoned B-2 Highway <br />Business; and the Subject Property is adjacent to Highway #10 on its northern boundary. <br />8. That there is approximately 1,100 feet between the nearest residential neighborhood and the Subject <br />Property. <br />-312- <br />
