• <br /> <br />• <br />C ~- I~'! ~ r~ Ji-~e S <br />Case #9: <br />vu~~ ~(~ <br />,aO~y <br />Request-for Final Plat and Final Site Plan Approval of GAD's .Prairie; <br />Case of Tri-Cor Development <br />Associate Planner Dalnes reviewed that in May of 2006, the City received an application <br />from Gary and Aaron Stritesky to develop seven detached townhomes on the property <br />generally. located south of 146ti' Avenue on County Road #5. In conjunction with this <br />plat, a request for a rezoning to Plaizned Unit Development (PUD) was also submitted to <br />allow for a unique housing type of detached townhomes and reduced setbacks. The City <br />Council considered the preliminary plat and a zoning amendment to PUD for GAD's <br />Prairie and unanimously approved both requests on a 6-0 vote, with Councilmember <br />Jeffrey absent. Ms. Dalnes stated since May of 2006, the Stritesky's have sold their <br />interests in GAD's Prairie to Tri-Cor Development. After unsuccessfully seeking a <br />revised .preliminary plat proposal, Tri-Cor has submitted a final plat application that <br />substantially conforms to the approved preliminary plat. ~At the City Council meeting on <br />May 22,-2007, the City Council tabled action on the final plat for the applicant to come <br />back with a revised plan that indicates the ability to accommodate a future cul-de-sac on <br />the property. The applicant has revised the final plat sheet to indicate afull-size cul-de- <br />sac on the property that would replace access onto CSAH 5 when Helium Street is <br />extended north to 146th Avenue. However, it requires the re-location of the stormwater <br />pond and re-positioning of the units on the property. The revised final plat is included in <br />the Council's packet. In essence the plan proposes to relocate the pond and develop the <br />two lots to the north that were formerly outlots because of that pond. <br />Associate Planner Dalnes stated staff is requesting that both the southern cul-de-sac and <br />the northern temporary cul-de-sac be constructed at this time. This would take minor <br />revisions to the exhibit. The purpose of this is to avoid potential conflicts with <br />attempting to construct the cul-de-sac at a later date after residents are living there. Due <br />to the cul-de-sac configuration the PUD agreement has established with the .development <br />agreement, there will need to be a stipulation for reduced front yard setback for those two <br />lots on the south side of approximately 10 feet. The Fire Cliief has reviewed the potential <br />future cul-de-sac and the future length would be approxmately 980 feet from 146th <br />Avenue to the terminus. The Fire Chief is comfortable with this length due to the <br />proximity to 'the Nowthen Boulevard right-of--way and also that this is a hydrogenated <br />area. There are similar cul-de-sacs in the City. The Fire Chief would like it noted that <br />any fencing or additional significant screening efforts would unpact the ability to easily <br />access this property from Nowthen Boulevard. Staff recommends -any additional <br />screening be small shrubbery or other landscaping efforts. Staff is recommending <br />approval contingent upon the City Staff Review Letter, the developer entering into a <br />development PUD agreement, and the approval of an acceptable grading plan indicating a <br />revised pond location. The applicant is requesting Council action before any further <br />revisions are made to the site plan. Property owner Tim Boe is present to answer any <br />questions of the Council. <br />Councilineinber Jeffrey stated he has not been in favor of this because of the access issue. <br />The County letter discusses this as not being a .favorable access.
