cars to go onto Highway 5 at the last meeting and squabbling over 14 cars at this meeting. This <br />is considerably more and it is a safety concern. <br />Councilmember Jeffrey stated the location'«rhere these cars will come out is between 146', Lord <br />of Life, and the next street over with no bypass lanes or turn lanes. It is a hazard. If it were <br />coming out to 146' he would be fine with it. This will force the issue for the City to move <br />forward and purchase a piece of property at some point in time, which may be what the person in <br />the middle is looking for. <br />Councilmember Elyig stated in all fairness, he thinks the reason this was tabled was because they <br />felt it was going to fail and they wanted to give the applicant another opportunity. The Council <br />appreciates that the developer has come back many. times. They are trying to make something <br />work. They are in a situation where they will come down to a vote, most likely tonight. He <br />would like to explore one more piece of information regarding the potential compromise <br />Councilmember Olson laid out of a right-out. <br />Public Works Director Olson indicated the only way to accomplish that is by putting a median <br />in, which would need to go all the way to 146' Avenue because they would not want people <br />making a u-turn inthe middle of a block. <br />Councilmember Elvig questioned if a right-out could not be done reasonably or affordably <br />~~ithout impacting the major roadway. <br />Public Works Director Olson replied there would need to be a hard median put in up to 146 <br />Avenue. The seven dwelling units coming home in the evening would need to do a u-turn to get <br />Home. <br />Councilmember Look stated he sees this strip of land that they are discussing as the key to all <br />three properties developing. He questioned if there is any way to assess the properties at the <br />point of development to pay. for a portion of the cost if the City is required to acquire property to <br />complete the road. _ <br />City Attorney Goodrich replied there could be an assessment if the properties benefit by the <br />amount of the assessment proposed. There would need to be an appraisal that shows that all the <br />properties would increase in value by the amount of the assessment. He is not- certain if a safer <br />access «~ould increase the value of the property. <br />Mr. Jenson indicated it would be questionable whether there would be sufficient value, but in <br />terms of the possibility of the north property being developable as opposed to what they have <br />now he would see that as an improvement in their value. <br />Councilniember Elvig stated if this were denied tonight and a motion were to come forward to <br />proceed vaith eminent domain for continuation of the road on the middle parcel, or if a willing <br />seller proceeds vaith the middle parcel resulting in gained access, and with the basis that-the <br />church is also a willing seller resulting in continued access, there would be no question in his <br />mind that the action of taking that property for access purposes «~ould benefit this property.
