WHEREAS, the Public Works Committee and City Council have agreed to utilize up to <br />$60,000.00 to acquire the right-of--way necessary to extend Helium Street, and that the developer has <br />• agreed to .pay for the construction of the street, and any acquisition or legal fees in excess of <br />$60,000.00. <br />WHEREAS, the final plat substantially conforms to the preliminary plat approved oii June 28, <br />2006; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants final plat approval of GAD's .Prairie in accordance <br />with relevant City Codes, subject to the following coriditions: <br />1) Compliance with the City Staff Review Letter dated May 18, 2007; <br />2) The submittal of finalized grading and drainage plans that incorporate road construction and <br />runoff into the plans; <br />3) Revision of the final plat to .include Helium Street right-of--way extension to 146' Avenue, <br />acquisition and construction of Helium Street; <br />4) Developer entering into a Development Agreement that specifically requires the conveyance of <br />a surety for Helium Street construction prior to acquisition of the right-of--way. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />and upon vote being taken thereon, the following voted in favor thereof: <br />• <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this the <br />l la' day of December, 2007. <br />Mayor <br />ATTEST: <br />City Clerk <br />• <br />RESOLUTION #07-08-~ <br />Page 2 of 2 <br />-371- <br />
