The site does produce plants and vegetation; however, most of the production is indoors. The
code defines paths and parking areas that are gravel and dirt as impervious surfaces. Staff used
these guidelines in preparing the revised calculations.

The site may be eligible for the ponding credit provided for in the ordinance. The applicant's
engineer must submit calculations and the application form for review. The rate history is
summarized below:

Year
2000
2000
2000
2006
2006

Rate $/ Qtr
3697.34
1170.04
588.16
2461.46
3346.06

Comment
Rate based on total acreage
Rate based on developed area 16 acres @ 55% impervious
Rate based on 50% residence, 50% Business
Rate based on 2004 site visit
Rate based on 2005 aerial photo and May 2006 site visit

Discussion:

The applicant appeared before this board on May 16,2006 and asked that their rate not be
changed until they explored options for new credits. Plans were submitted showing building
additions with ponding and a storm sewer pipe draining the north side of the site. The building
additions were completed in 2006. A revised site plan was submitted in 2006 which showed a
pond on the south side of the property. The pond would meet the criteria for providing a
stormwater credit to the site. The credit extension was granted to allow time to construct the
pond. The credit for ponding would be applied when a completed application was submitted and
reviewed. Two construction seasons have passed since the last time this was discussed and the
pond has not been constructed.

Staff Recommendation:

Staffrecommends the appeal be denied and the property be billed at the new rate of $3,447.96/
qtr. The rate can be adjusted based on the credit application.

Committee Action:

Based upon discussion.

Reviewed by:
Director of Public Works/Principal Engineer

PW: 12/18/07

2
