<br />CASE #: e <br /> <br />REQUEST TO ADOPT ORDINANCE TO REZONE GAD'S PRAIRIE PROPERTY TO <br />PLANNED-UNIT-DEVELOPMENT: CASE OF TRI-COR DEVELOPMENT <br />By: Breanne DaInes, Associate Planner <br /> <br />Background: <br /> <br />The ordinance to approve the rezoning to PUD for the GAD's Prairie was introduced with the <br />preliminary plat application on June 27, 2006, and it is standard practice to adopt the ordinance at <br />the time of Final Plat. However, the final plat request was subsequently tabled, and the rezoning <br />ordinance was postponed until final approvals. <br /> <br />The City Council approved the final plat for GAD's Prairie on December 11, 2007. The proposed <br />ordinance will rezone the property from R-2 Medium Density Residential to Planned-Unit- <br />Development. The project conforms to the density requirements for the R-2 district, but is <br />proposing deviations from the Code with regard to setbacks and street right-of-way width, as <br />approved by the final plat. <br /> <br />The following information is included in your packet: <br /> <br />a) Site location map <br />b) Final Plat and Site Plan <br />c) Findings of Fact, adopted June 2ih, 2006 <br />d) Proposed Ordinance <br /> <br />Notification: <br /> <br />In accordance with City Code, property owners within 700 feet of the subject property were <br />notified of the public hearing at the Planning Commission meeting on June 1 st, 2006. <br /> <br />Observations: <br /> <br />The ordinance is now eligible for adoption. <br /> <br />Funding Source: <br /> <br />The Developer is responsible for all costs associated with processing the land use application and <br />the development. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends adoption of the ordinance. <br /> <br />I<~~ <br /> <br />-309- <br />
