FEES No license shall be issued under this ordinance until the. appropriate license fee ~s paid in full. A two-tier license fee structure may be established by City Council in the annual rates and fees, whereby incentive is provided to a license holder to utilize- age verification technolo;?y that meets performance requirements determined by the City. 1. The applicant shall be specifically ua u-ed by sworn statement to declare whether it will utilize aee verification technology. 2. The applicant must submit verification of the establishment and utilization of a trainin;; program for clerks responsible for the sale of tobacco products. 3. The age verification system must be used for every tobacco sale. SECTION 5. BASIS FOR DENIAL OF LICENSE The following shall be grounds for denying the issuance or renewal of a license under this ordinance; however, except as may otherwise be provided by law, the existence of any particular ground for denial does not mean that the City of Ramsey must deny the license. If a license is mistakenly issued or renewed to a person, it shall be revoked upon the discovery that they person was ineligible for the license under this section: a. The applicant is under the age of eighteen (18) years. b. The applicant has been convicted within the past five years of any violation of a Federal, State or local law, ordinance provision, or other regulation relating to tobacco or tobacco products, or tobacco related devices. c. The applicant .has had a license to sell tobacco, tobacco products, or tobacco related devices. revoked within the preceding twelve months of the date of application. Deleted: In addition, the licensee shall be required to educate each new employee who will be selling tobacco or tobacco products with regard to the requirements of this ordinance and State law pertaining to the sale of tobacco products to minors. The licensee shall be required to keep on file evidence of the employee educational session and make available for review said evidence upon reasonable request by the City Police Depamnent.
