7.93 Tobacco. Sales, Section 4. Fees No license shall be issued under this ordinance until the appropriate license fee is paid in full. The fee for a license under t11is ordinance shall be as established annually by City Council resolution. a. A two-tier license fee structure may be established by City Council in the annual rates and fees, whereby incentive is provided to a license holder to utilize age verification technology that meets performance requirements determined by the City. 1. The applicant, shall. be specifically required by sworn statement to declare whether it will utilize age verification technology. 2. The applicant must submit verification of the establishment and utilization of a training program for clerks responsible for the sale of tobacco. products. 3. The age verification system must be used for every tobacco sale.- SECTION 3. SUMMARY The following is the official summary of Ordinance #08-XX which has been approved by the City Council of the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. The ordinance deletes the current term language which states that "all licenses issued under this ordinance shall be valid for one calendar year from the date of issue. The new language amends the term of the license so that it is from January 1 to December 31 and any license applied for after January 1 shall have an effective date. of when Council approves the license. -Such license shall be in effect through December 31 of that year. The education requirements section is split into two paragraphs and more clearly defines what the requirements are. The. ordinance deletes the. current fees language. which states that "No license shall be issued under this ordinance until the appropriate license fee shall be paid in full. The fee for a license under this ordinance shall be as established annually by City Council resolution. The new language implements atwo-tier license fee structure whereby the license holder will pay a lesser license fee if age verification technology that meets performance requirements determined by the City is utilitized for every tobacco sale. SECTION 4. EFFECTIVE 1JATE The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City Charter Section 5.07. -152-
