CASE. # 9
INTRODUCE INTERIM ORDINANCE FOR A MORATORIUM ON CONDITIONAL
USE PERMITS FOR THE CONSTRUCTION OF CELL TOWERS WITHIN THE CITY
OF RAMSEY, ANOKA COUNTY, MINNESOTA; CASE OF CITY OF RAMSEY
By: Tim Gladhill, Management Intern
Background:
On January 8, 2008, City Council directed staff to draft an Interim Ordinance for a moratorium
on Conditional Use Permits (CUP) to construct cell .towers within the City of Ramsey. The
moratorium is proposed to be effective from February 17, 2008 through Augustl7, 2008. The
purpose of the moratorium is to provide time to study and consider revisions to the cell tower
standards.
The followingitems are enclosed for your information:
a) Proposed interim ordinance
Notification:
A public hearing is not required to adopt an interim ordinance.
Funding:
No funding required to adopt. an interim ordinance.
Observations:
The purpose of this moratorium is to allow staff time to study possible revisions to the current
cell tower ordinance. There has been significant discussion regarding, height of towers,
placement of towers, as well as some minor revisions needed since the addition of the
Public/Quasi-Public zoning designations to City Code. Antennas will continue to be allowed to
be attached to existing structures.
State Statute authorizes cities to adopt a moratorium for up to T year, with additional time
allowable under special circumstances. Depending on the publication date in the Anoka Union,
this would enact the moratorium starting February 17, 2008.
A Council Work Session regarding the possible amendments will be scheduled for a later date:
Recommendation:
Staff recommends adoption of the interim ordinance.
-221-
