ORDINANCE N0.08-xx CITY OF RAMSEY ANOKA COUNTY: STATE OF MINNESOTA AN INTERIM ORDINANCE FOR A MORATORIUM ON CONDITIONAL USE PERMITS FOR THE CONSTRUCTION OF CELL TOWERS WITHIN THE CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA The City of Ramsey Ordains: SECTION 1. AUTHORITY This Ordinance is adopted pursuant to that authority granted to the City by MSA 462.355, Subd. 4, entitled "Interim Ordinance." SECTION 2. PREAMBLE AND PURPOSE WHEREAS, on January 8, 2008, City Council directed staff to prepare an interim ordinance for a moratorium on Conditional Use Permits (CUP) to construct cell towers in the City of Ramsey in order to study alternatives to current tower regulations; and WHEREAS, the City Council finds that Section 9.15 of the Zoning Code relating to `Towers' is currently insufficient in terms of height requirements and placement of said towers; and WHEREAS, Section 9.15 of the Zoning Code is in need of additional updating since the adoption of the Public/Quasi Public Zoning District; and WHEREAS, `Antennas', as defined in Section 9.15 of the Zoning Code, will continue to be allowed to be attached to existing structures and towers and will not be affected by the interim ordinance; and WHEREAS, the City Council finds that an interim ordinance for a moratorium on CUPS for the construction of cell towers within the City of Ramsey, except those specifically excluded below, is necessary to protect the planning process and the health, safety and welfare of the citizens of Ramsey. SECTION 3. STUDIES .The City Council hereby directs its City staff to bring forward possible amendments to Section 9.15 of City Code in the areas of height, location, and effects on adjacent property and report back suggested ordinance language ammendments. SECTION 4. PROHIBITION During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Towers", no Conditional Use Permit (CUP) will be granted to construct a cell tower within the City: and no -223-
