<br />11. The Owner shall reference or insert the terms of this CE & R in any deed <br />or other instrument of conveyance which conveys title to the Easement <br />Areas. The Owner shall also specify to what extent reserved rights have <br />been exercised, if at all, and are no longer available for use by the new <br />owner and which reserved rights are specifically allocated to the property <br />being conveyed in accordance with other provisions of this CE & R. <br /> <br />The enforceability or validity of this CE & R will not be impaired or <br />limited by any failure of the Owner to comply with this subparagraph. <br /> <br />B. Subdivision. The Easement Areas may be divided into lots and configurations <br />permitted at the time of its subdivision. Each newly created lot will otherwise <br />remain subject to the terms and conditions of this CE & R. <br /> <br />This right to subdivide the Easement Areas does not include the right to construct <br />any buildings or structures except to those otherwise permitted by this CE & R. <br /> <br />C. Recreational and Educational Uses. The Easement Areas may be used for hiking, <br />cross-country skiing, horseback riding, camping, nature observation or study, and <br />other similar low impact recreational and educational programs or activities by <br />the Owner. Any recreational or educational program or activity undertaken <br />pursuant to this paragraph must be exercised in a manner which is consistent with <br />the Conservation Values set forth in this CE & R. <br /> <br />D. Habitat. The Easement Areas may be used to maintain, restore or enhance habitat <br />for wildlife and native biological communities in accordance with a management <br />plan approved by the City in writing. <br /> <br />SECTION 4 <br /> <br />Citv Rie:hts. In order to accomplish the purposes of this CE & R, the City has the following <br />rights with regard to the Easement Areas: <br /> <br />A. Ecological Management. The City may enter, upon reasonable notice to the <br />owner, the Easement Areas for purposes of managing or controlling diseased <br />trees, noxious weeds and invasive species. <br /> <br />B. The rights, uses and activities set forth in Section 3 C. and 3 D. of this CE & R. <br /> <br />C. Signs. The City has the right to place on the Easement Areas signs that identify <br />the land as protected by this CE & R. <br /> <br />D. Right to Enter. The City has the right to enter the Easement Areas upon <br />reasonable notice to the owner for the following purposes: <br /> <br />1. To inspect the Easement Areas and to monitor compliance with the terms <br />of this CE & R. <br /> <br />5 <br />
