PUBLIC HEARING <br /> <br />Acting ChairPerson LaDue adjourned the regular Board of Adjustment meeting at 7:32 p.m. in <br />order to coni:lUct the following public hearing: <br /> <br />1) Request for a variance to front yard setback requirements; Case of Jeffrey Cross <br /> <br />Acting Chait'person LaDue called the regular Board of Adjustment meeting back to order at 7:35 <br />p.m. <br /> <br />BOARD I~UShNESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Front Yard Setback Requirements; Case of <br />Jeffrey Cross <br /> <br />Acting Cha',a'Person LaDue summarized the findings of facts. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to make the following <br />amendments to the findings: #12: "That if granted, the proposed variance will not impair an <br />adequate supply 'of light and air to adjacent property". //13: "That if granted, the proposed <br />variance will r~ot Unreasonably increase the congestion in the public street". #14: "That if granted, <br />the proposed Yadance will not adversely impact the degree of public health, safety and general <br />welfare provided ;for in the Ramsey City Code". #15: "That if granted, the proposed variance will <br />not unreasoSga~bly:diminish established property values within the neighborhood". #15: "That if <br />granted, the ~roposed variance will not unreasonably diminish established property values within <br />the neighborhood". //17: "That if granted, the variance will not grant the Applicant any special <br />privilege thal is denied to other owners of land in the same district." <br /> <br />Motion carded. ;Voting Yes: Acting Chairperson LaDue, Commissioners Deemer, Holland, <br />Bawden anO. Thorud. Voting No: None. Absent: Chairperson Hendriksen and Commissioner <br />Terry. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner Thorud to amend #16 to read: <br />"That the uflique~circumstances on the subject property do not result from the actions of the <br />Applicant". <br /> <br />Motion carried. Voting Yes: Chairperson LaDue, Commissioners Bawden, Thomd, Deemer and <br />Holland. V°,ting No: None. Absent: Chairperson Hendriksen and Commissioner Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to adopt Resolution <br />#92-()4-069 ~ppr0ving Jeffrey Cross' request for a variance based on Findings of Fact #0309, as <br />amended, anddeelaring terms for said variance at 5730 - 142nd Avenue N.W. <br /> <br />Motion carried. Voting Yes: Chairperson LaDue, Commissioners Deemer, Bawden, Holland and <br />Thorud. Vo!ing No: None. Absent: Chairperson Hendriksen and Commissioner Terry. <br /> <br />The CommiSsion reviewed the terms of the variance. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to add the following <br />term: "The/tin shed should be moved entirely onto the applicant's property following the <br />occupancy of the garage". <br /> <br />Board of Adjustment/April 23, 1992 <br /> Page 2 of 3 <br /> <br /> <br />
