BOARD <br /> <br />i tJSINV. SS <br /> <br />Case #1: Request for a Variance from Front and Side Yard Setback <br /> : R~quirements; Case of Eugene Dubois <br /> <br />Mr. Eugen~ Dubois was present requesting a variance from front and side yard setback <br />requiremen¢ in the rural residential district in order to construct an addition to his attached garage <br />at 15030 W!llemlte Street N.W. Mr. Dubois noted that when his home was originally sited on the <br />lot, the dev~Iop~ did it in such a way that any enlargement of the garage is prohibitive without <br />encroaching.. On setbacks. <br /> <br />Motion by COmmissioner Deemer and seconded by Commissioner Holland to adopt Resolution <br />#92-09-248~'decl~a'ing Findings of Fact # 0323 with items #12 through 16 to read in the positive. <br /> <br />Further disoussion: Commissioner Terry stated that granting Mr. Dubois a variance to enlarge his <br />attached garage by the size requested may be bordering on granting him special privileges. Mr. <br />Dubois replied that he can't expand his garage space by utilizing the rear yard because he lives <br />adjacent to a wetland and his back yard floods in the spring. Mr. Dubois also noted that making an <br />addition to his atlached garage is giving him much less square footage for garage space than he's <br />allowed b~ City Code. Also, he would like to have the garage expanded as planned for <br />accessibility purposes. Mr. Dubois further noted that if he built his accessory garage in the rear <br />yard, it wo~ld obstruct the view of the park for his neighbors and it would require him to bring in a <br />great deal of fill. <br /> <br />Motion carded. Voting Yes: Chairperson Hendriksen, Commissioners Deemer, Holland, LaDue, <br />Terry and ~'~homd. Voting No: None. Absent: Commissioner Bawden. <br /> <br />Motion by ~ommissioner Deemer and seconded by Commissioner LaDue to adopt Resolution #92- <br />09-249 to gl'ant a variance to side and front yard setback requirements based on Findings of Fact <br />#0323 to 15030 Willemite Street N.W. <br /> <br />Motion carded. Voting Yes: Chairperson Hendriksen, Commissions Deemer, LaDue,. Holland, <br />Terry and'14homd. Voting No: None. Absent: Commissioner Bawden. <br /> <br />ADJOURNMENT <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to adjourn the regular <br />meeting of ~e Board of Adjustment. <br /> <br />Motion carded. Voting Yes: Chairperson Hendriksen, Commissioners LaDue, Holland, Deemer, <br />Terry and Thorud. Voting No: None.
