Councilmember Dehen outlined some changes he would like to make to the wording of the letter and survey. Case #5: Update on Ermine Boulevard Storm Sewer Project Chair Elvig deferred this discussion to the next meeting, due to time constraints. COMMITTEE INPUT Update on Highlands at River Park Pond City Engineer Jankowski stated that staff was directed at the October Public Works Committee meeting to investigate potential causes of leaks in the River Park Pond and also to have the City Attorney determine the City's ability to use the developers escrow to correct the leaking problem. He stated that staff has ordered additional dye and has done from private investigation to the elevation of retaining walls constructed on private property adjacent to the ponds. He stated that at least one of the retaining walls has been constructed lower than the pond liner elevation and found fragments of pond liner material adjacent to the retaining wall. He stated that there were also some monuments that have been pounded through the liner. He stated that the City has also been monitoring the elevation of the pond and, as of yesterday,, it was at 856.7 feet, which means there is less than 2 feet of water in the pond. He stated that the City Attorney feels that the escrow funds were earmarked for inspection purposes only, so he does not feel the City can use the remaining funds to correct the leaking problems, because the City has already accepted the pond. Chair Elvig asked if the City was aware of the leaking problem when the pond was accepted. City Engineer Jankowski stated that the City was not aware of the leaking problem at that time. Chair Elvig asked what the latest results were of the dye testing. City Engineer Jankowski stated that they have not used the dye again because in order to administer it according to directions, the pond would need to be filled up at a cost of about $3,000, additional dye would be needed at a cost of $2,500 and there is still no guarantee that the leaks could be located. He stated that the developer has been in contact with the residents and has indicated an interest in doing something to remedy the situation. Scott Rothrum, 15370 Xcimo Street, stated that that although he does not want to speak for the developer, he is under the impression that the developer was going to send an e-mail to the City Public Works ,Committee /November 20, 2007 Page 8 of 9 _169_
