CASE # <br />• <br />ADOPT INTERIM ORDINANCE FOR A MORATORIUM ON CONDITIONAL USE <br />PERMITS FOR THE CONSTRUCTION OF CELL TOWERS WITHIN THE CITY OF <br />RAMSEY, ANOKA COUNTY,_MINNESOTA; CASE OF CITY OF RAMSEY <br />By: Tim Gladhill, Management Intern <br />Background: <br />On January 22, 2008, City Council introduced an Interim Ordinance for a moratorium on <br />Conditional Use Permits (CUP) to construct cell towers within the City of Ramsey. The <br />moratorium is proposed to be effective from March 17, 2008 through. September 17, 2008. The <br />purpose of the moratorium is to provide time to study and consider revisions to the cell tower <br />standards. <br />The following items are enclosed for your information: <br />a) Proposed interim ordinance <br />Notification: <br />• A public hearing is not required to adopt an interim ordinance. <br />Funding: <br />No funding required to adopt an interim ordinance. <br />Observations: <br />The purpose of this moratorium is to allow staff time to study possible revisions to the current <br />cell tower ordinance. There has been significant discussion regarding height of towers, <br />placement of towers, as well as some minor revisions needed since the addition of the <br />Public/Quasi-Public zoning designations to City Code. Antennas will continue to be allowed to <br />be attached to existing structures. <br />State Statute authorizes cities to adopt a moratorium for up to 1 year, with additional time <br />allowable under special circumstances. Depending on the publication date in the Anoka Union, <br />this would enact the moratorium starting March 17, 2008. <br />A Council Work Session regarding the possible amendments will be scheduled for a later date. <br />Recommendation: <br />• Staff recommends adoption of the interim ordinance. <br />287 <br />
