Absent: Councilmember Elvig. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Olson, to adopt Resolution <br />#12-07-335 determining that an Environmental Assessment Worksheet is not warranted, based <br />on the Findings of Fact, referenced above. <br /> <br />Further Discussion: Councilmember Strommen stated that she agrees with the conclusion that an <br />EA W is not warranted, but based on earlier discussion, she opposes adopting this resolution. <br /> <br />Motion carried. Absent: Councilmember Elvig. <br /> <br />Case #2: <br /> <br />Request for Amended Conditional Use Permit (CUP) to Allow Motocross, <br />Demolition Derby, Rodeos, and Bull Riding Events on the Diamonds Sports <br />Bar Property; Case of Gary Gruber <br /> <br />Mayor Gamec stated that the City had received petitions from citizens and business owners <br />showing support for Diamonds Sports Bar to allow the proposed activities and e-mail <br />communications from citizens and business owners that object to this application and noted they <br />have been entered in the record. <br /> <br />Gary Gruber of Diamonds Sports Bar stated that staff has recommended that an Interim Use <br />Permit be given and he is confident that they can prove to the City Council and the neighbors <br />that his plans will work out and not be a nuisance. He stated that the Special Events Permit <br />currently require him to appear before the City Council for each event and stated that he did not <br />think it would be a wise use of anyone's time for him to appear before the City Council for every <br />event. He stated that he would also like the City to consider the money he has already spent <br />throughout this process and also his plans to donate the scoreboard that is being taken down to <br />accommodate this plan to a youth program. He stated that he would appreciate any consideration <br />the City Council could give to his actions. <br /> <br />Bill Wright, 7884 - 142nd Avenue, stated that he lives 3 houses away and wanted to remind the <br />City Council that the Planning Commission has recommended denial of this project two times. <br />He stated that he feels this application will adversely affect the environment and the use of his <br />property. He stated that the original proposal eliminated the 7 days a week softball, but the new <br />proposal put softball back playing 7 nights a week. He stated that events now will be scheduled <br />for Friday, Saturday and possibly Sunday. He stated that he feels this request is to boost the <br />economic income of one person in the City at the expense of many residents and asked the City <br />Council to deny this request. <br /> <br />Mayor Gamec stated that he feels this is something that is not needed in the area. He stated that <br />he understands that this is an emotional issue on all sides, but does not think this application is in <br />the best interest of the City. <br /> <br />City Council / December 11,2007 <br />Page 8 of 25 <br />
