<br />Case #1: <br /> <br />Green Valley Greenhouse Storm Water Utility Fee <br /> <br />Civil Engineer Linton reviewed some of the information that was shared at the May 16, 2007 <br />Public Works Committee meeting. He noted that property owner John Rowe was present to <br />discuss the issue. He stated that originally this property had a homestead and a business on it, so <br />there was a 50% credit for both rates for the storm water utility fee. In 2004, the homestead was <br />sold off and platted. In April of 2006, a letter was sent to Mr. Rowe informing him that because <br />of this change, the property no longer qualified for the 50% credit. He stated that Mr. Rowe <br />appealed this change and presented a plan to construct ponding on the site which would make the <br />property eligible for a credit. He showed aerial photos from 2003 and 2006 that showed a <br />considerable increase in hard surface area on the property. He stated that two construction <br />seasons have passed and no pond has been constructed. He stated that staff is recommending <br />that this property pay the full rate until the ponds are constructed and credit can be granted. <br /> <br />Chairperson Elvig stated that there is drainage from Green Valley Road that ends up in this <br />driveway and asked ifthis was attributable to run off from this property or from the road. <br /> <br />Civil Engineer Linton stated that it is a combination of factors and part of the original proposal <br />was to put in a pipe to provide natural drainage for the area so the City would not have to pump <br />it. <br /> <br />Councilmember Dehen asked if staff was recommending that the- fees are retroactive to 2004 or <br />from this day forward. <br /> <br />Civil Engineer Linton stated that the rate would not be retroactive. <br /> <br />Councilmember Dehen stated that this issue could have been brought before the Public Works <br />Committee back in 2004 and he feels Mr. Rowe has had 4 years of benefit from not been charged <br />for storm water utility fees. <br /> <br />Mayor Gamec stated that he didn't think the current ditch was big enough to hold water from the <br />road. <br /> <br />Public Works Supervisor Reimer stated that there is not a well defined ditch directly in front of <br />this property and the property is somewhat of a low area. <br /> <br />Mayor Gamec stated that drainage is supposed to be maintained on your own property and asked <br />whether the wetland area is on Mr. Rowe's property or on private property. <br /> <br />Civil Engineer Linton stated that part of the wetland is on private property and part is on Mr. <br />Rowe's property. <br /> <br />Councilmember Dehen asked how the utility fees are calculated. <br /> <br />Public Works Committee /January 15, 2008 <br />Page 2 of 13 <br />
