<br />Presentation <br /> <br />Interim Community Development Director Frolik stated Gerald Bauer owns a 34.72 acre parcel <br />at the northwest quadrant of Variolite Street and 161st Avenue NW. Mr. Bauer has drawn up <br />deeds to donate the land to the Church of Saint Katherine Drexel over a two year period <br />(2007/2008). Conveyance of the land in a two year period requires subdividing the property into <br />two lots. Mr. Bauer has committed to donate 25 acres to the Church for 2007 and 9.72 acres in <br />2008. Ms. Frolik explained that City Code requires platting for the subdivision of property. City <br />Code establishes a process to grant a variance to platting requirements when strict compliance <br />with these requirements may cause a practical difficulty or undue hardship, provided the variance <br />does not affect the spirit and intent of this section of City Code. Ms. Frolik stated the applicant <br />has said that requiring platting in order to convey the 34 acres as a 25 acre lot and a 9 acre lot to <br />the Church over a two year time frame does not present a practical difficulty. Had the <br />conveyance been planned as a 34 acre donation in a one year time frame there would have been <br />no review required by the City. <br /> <br />Ms. Frolik advised staff is recommending that the variance be conditioned upon the Church <br />performing a lot combination when the deeds are recorded at Anoka County so that the lot split <br />does not have the affect of creating an additional buildable lot. With a lot combination, the <br />County assigns one parcel identification number to both properties, with only the 34 acres being <br />eligible for one building permit. To obtain a second parcel identification number for the property, <br />City approval will be required, and the City may require platting at that time. The variance will <br />also require compliance with subdivision regulations. <br /> <br />Citizen Inuut <br /> <br />There was none. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Strommen, to close the public <br />hearing. <br /> <br />Motion carried. V oting Yes: Mayor Gamec, Councilmembers Olson, Strommen, and Look. <br />Voting No: None. Abstain: Councilmember Elvig. Absent: Councilmembers Dehen and <br />Jeffrey. <br /> <br />The public hearing was closed at 7:26 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:26 p.m. <br /> <br />Councilmember Strommen requested clarification that approval of a conditional use permit for <br />the Church on this property in the future will require site plan review. <br /> <br />Interim Community Development Director Frolik responded affirmatively. She noted item 3b of <br />the variance states "That any further subdivision of the Subject Property shall be in accordance <br /> <br />City Council / February 12,2008 <br />Page 7 of 13 <br />
