Zoning Bulletin

Home Business-Firearms dealer denie<;J license claims
business allowable in residential zone under ordinance

Township tells licensing agency otherwise

Citation: Morgan v. Federal Bureau of Alcohol, Tobacco &
Firearms, 2007 WL 4335512 (6th Cir. 2007) .
The 6th U.S. Circuit Court of Appeals has jurisdiction over Ken-
tucky, Michigan, Ohio, and Tennessee.

MICIDGAN (12/13/07)-Morgan dealt firearms from his residen-
tial premises in Redford Township for several years. Every three
. years, Morgan applied to the Federal Bureau of Alcohol, Tobacco
& Firearms (ATF) for a renewal of his federal firearms license.
Morgan identified his home as his "business address" on his li-
cense renewal applications.
Beginning in 1994, applicants for new or renewed firearms li-
censes were required to certify that "the business to be conducted
under the license [was] not prohibited by State or local law." In
response, Morgan obtained an opinion letter from a local attorney
stating that his firearms business was a permissible home occupa-
tion within the meaning of the township's zoning regulations.
