Kittitas County, 174 P.3d 25 (Wash. 2007) <br /> <br />CESS owned 251.63 acres of land in Kittitas County (the Prop- <br />erty). The Property was originally zoned forest and range (F & R). <br />F & R zones permitted minimum lot sizes of 20 acres. CESS ap- <br />plied for a site-specific rezone from F & R to Rural-3 (R-3). R-3 <br />zones permitted minimum'lot sizes of 3 acres. The Kittitas County <br />Planning Commission and the Kittitas County Board of County <br />Commissioners (BOCC) approved the rezone. <br />Woods, a neighboring landowner, challenged the rezone. Woods <br />filed a Land Use Petition Act (LUPA) in superior court. Woods' pe- <br />tition claimed the BOCC decision erroneously interpreted the law <br />because it (1) used (a) incomplete findings and (b) site-specific re- <br />zone standards; and (2) failed to include determinations regard- <br />ing (a) changed circumstances and (b) consistency with the state's <br />GroWth Management Act (GMA). The GMA required a minimum <br />of five acres in rural areas. Woods also argued the BOCC decision <br />was not supported by substantial evidence.
