<br />f <br />J <br />fO <br /> <br />P22 <br />Councilmember Anderson introduced the following resolution an moved for its adoption: <br /> <br />RESO L UTI 0 N #00-03-077 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />AMENDMENT FOR ESTABLISHMENT OF ADDITIONAL ACCESSORY OUTDOOR <br />RECREATIONAL USES TO A RESTAURANT AND BAR BASED UPON FINDINGS OF <br />FACT #0512 AND DECLARING TERMS OF SAME. <br /> <br />WHEREAS, Diamonds Sports Bar & Grill, Inc. (Permittee) has properly applied for a <br />co~ditional use permit (CUP) amendment on the property legally described as follows: <br /> <br />Lot 1, Block 1, The Diamonds, Anoka County, Minnesota <br />(the "Subject Property"); and <br /> <br />WHEREAS, the Planning Commission met on March 6, 2000, conducted a public <br />hearing and recommended City Council approval of the request. <br /> <br />- <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as f~lIows: <br /> <br />1) Term: This permit shall be perpetual in its duration so long as the conditions imposed <br />herein are complied with. <br /> <br />2) Site Development: The development and operation of the outdoor recreational facilities <br />shall be specifically limited to that described in the Permittee's site plan. (See attached <br />Exhibit "A" dated February 8, 2000). <br /> <br />3) Splat Ball Use: With regard to the splat ball use, the following specific conditions shall <br />apply: <br /> <br />a) The hours of operation shall be. 1 0:00 a.m. to dusk, seven (7) days a week. <br />b) Any lighting of the splat ball area will require City Council approval following a <br />public hearing. <br />c) No intoxicated participants shall be allowed to participate. <br />d) The splat ball use shall require an additional, separate $1,000,000.00 public <br />liability insurance policy as approved by the City. <br />e) The City, in its discretion, may review the splat ball use in the event it receives <br />frequent complaints about the noise level from the use. This review procedure <br />shall be the' same as the conditional use permit revocation procedure of Chapter 9 <br />of the City Code. Excessive noise complaints shall be cause for revocation of the <br />splat ball use. <br />f) Because of this unique use, with no previous history in the City, .the City reserves <br />the right to revoke the splat ball use in the event it finds the use is either harmful' <br />to the public health and welfare and/or the quiet enjoyment and use of neighboring <br />properties. The City shall review the splat ball use two years from the date hereof <br />in order to determine its compatibility with neighboring properties and upon <br />review, determine if the use shall be permitted to continue. <br />
