REQUEST FOR A HOME OCCUPATION PERMIT; CASE OF APRIL MASTELL By: Breanne Dalnes, Associate Planner The following items are enclosed for your information: Notification: a) Site location map b) Site layout exhibits c) Proposed Findings of Fact, as approved by Planning Commission d) Proposed Council findings of fact e) Proposed home occupation permit Background: The City has received an application from April Mastell for a home occupation permit to establish a hair salon in her home located at 6421153`' Lane N.W. In accordance with State statute, Staff notified property owners within 350 feet of the subject property of the public hearing conducted at the Planning Commission meeting on March 6, 2008. Observations: Home occupations that are not conducted entirely by home computer, phone, or mail require the issuance of a home occupation permit, according to Section 9.11.04 (subdivision 1) of the City Code. The applicant is requesting a home occupation permit to conduct a salon business out of one room on the lower level of her home. The salon area will be accessible from both her garage and her main living area, and will be restricted to the dwelling unit. The total amount of space to be utilized for the business is 128 square feet, which will not exceed 20% of the living space of the home. There will be no outside employees, and a minimal number of clients. It should be noted that staff is bringing revisions forward to the home occupation permit requirements at the April Planning Commission meeting. Staff Recommendation: City staff recommends approval of the request for home occupation permit. The Planning Commission heard the applicant's request at the public hearing on March 6, 2008 and recommended approval of the home occupation permit.
