-164— <br />City retains the authority to conduct the inspection under the same review parameters it <br />would under a Special Events Permit process for this annual review. <br />5) All events must be conducted within the softball fields as shown on the Site Layout. <br />6) The Permittee will meet with City Staff to review all event details no less than two weeks <br />prior to each event. The applicant will not be exempt from state, county, and local <br />permits, excluding the local Special Events Permit. The City retains the authority to <br />conduct the inspection under the same review parameters it would under a Special Events <br />Permit process for this review. <br />7) Any improvements, including financial investment, the Permittee may make in reliance <br />on this IUP SHALL NOT be considered as factors by the City in the event the Permittee <br />applies for an extension of the IUP. <br />The development and operation of the outdoor uses shall be specifically limited to that <br />described in the Permittee's site plan and letter from the applicant dated January 25, <br />2008, submitted as part of the IUP application. <br />The Permittee shall provide sufficient off - street parking in accordance with the approved <br />site plan and City Code performance standards. <br />10) A Schedule of Events (including dates and times) for all events for the subject property <br />shall be submitted to the City no later than May 1, 2008. An annual schedule of events <br />for the entire site shall be submitted to the City no later than January 1 of each year for <br />the current year's events. <br />11) Building and parking lot lighting changes are subject to the approval of the City Engineer, <br />shall be arranged to deflect light away from adjoining properties and public streets, and <br />bulbs emitting in excess of 3,000 lumens shall be so directed that the bulb is not visible <br />from off of the Subject Property where such light source is located. <br />12) Any outdoor Public Address system or any sound emitting from the property may not <br />exceed the noise performance standards contained in City Code, and that, upon validated <br />complaints, such system's volume shall be reduced or the event causing the noise ceased. <br />Speakers must be directed away from adjacent residential areas. <br />13) Any new signage proposed for the Subject Property must meet City Code requirements. <br />14) If any provision of this IUP shall be declared void or unenforceable, the other provision <br />shall not be affected but shall remain in full force and effect. <br />15) This IUP shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br />16) The violation of any of the material terms of this IUP is grounds for suspension or <br />revocation hereof, consistent with applicable law.
