NOTE CITY COUNCIL MINUTES <br />The following Council minutes were noted: <br />1) City Council Regular meeting minutes dated November 27, 2007 <br />PUBLIC HEARINGS /COMMISSION BUSINESS <br />Case #1: Request for a Home Occupation Permit; Case of Carefree Home Services, <br />Inc. <br />Vice Chairperson Levine closed the regular portion of the Planning Commission meeting at 7:05 <br />p.m. in order to call the public hearing to order. <br />Public Hearing <br />Vice Chairperson Levine called the public hearing to order at 7:10 p.m. <br />Presentation <br />Assistant Community Development Director Frolik stated the City has received an application <br />from Michael Beach for a home occupation permit to operate a home health care business out of <br />his home, which is located at 7830 149 Lane NW. <br />The Beach family has been operating Carefree Home Services out of their home since 1990. <br />They currently have 2 full -time office employees, and an average of 10 home health care aides <br />that stop by the home office weekly to collect paychecks or complete other paperwork. Michael <br />Beach also lives in the home. <br />Around 1990, Michael's parents, Jerry and LeAnn Beach, consulted City Staff when they began <br />the business and were told they did not need to obtain any kind of special permit. <br />City Code restricts home occupations to 20% of the gross floor area of the home. The original <br />garage was converted to office space about 10 years ago, and a new garage was constructed. This <br />area appears to exceed this threshold. <br />Given the number of employees (both on- and off - site), and the floor space occupied by the <br />business, the Beaches are technically not eligible to receive a Home Occupation Permit under <br />City Code. Therefore, Staff cannot recommend approval of the request. However, given the <br />long tenure of the business, it might be appropriate for the Planning Commission and City <br />Council to consider an Interim Use Permit, to allow the Beaches some time to either find an <br />alternate site for the business, or to adjust their business practices such that employees are no <br />longer present at the home. Staff has included a draft Interim Use Permit for the Planning <br />Commission's consideration. <br />Chairman Nixt arrived at 7:08 p.m. <br />Planning Commission /January 3, 2008 <br />Page 2 of 8 <br />
