<br />stated that there was a separate Interim Use Permit Application for Diamonds denied at the <br />Planning Commission meeting on March 6, 2008. He noted that the applicant for that permit, <br />Monster Auctions, has since withdrawn their application. He stated that in order for the Council <br />to take any disciplinary action, a public hearing would need to be held and staff is recommending <br />that it be held on March 25,2008. He stated that this item is currently included on the Consent <br />Agenda for the Council meeting. <br /> <br />Mayor Gamec stated that this event was clearly a violation of the ordinance and asked what the <br />protocol was in this situation. <br /> <br />Interim Community Development Director Frolik stated that City Code states that if there is a <br />violation of the CUP and, if the Council wishes to consider disciplinary action, it must be <br />preceded by a public hearing. She stated that after the public hearing, the Council can choose to <br />take no action, suspend the CUP, or revoke the CUP. <br /> <br />Mayor Gamec stated that he feels a public hearing should be held and the action the Council will <br />take will be determined afterwards. <br /> <br />Councilmember Elvig stated that he agreed that a public hearing should be held because there <br />were phone calls made to staff and the Council. He stated that he feels the Council needs to <br />follow the City Code and respond to residents. <br /> <br />Councilmember Jeffrey stated that he is not opposed to holding a public hearing, but would like <br />some thought to be given to the format. He stated that the Council recently went through a <br />public hearing process related to this property and he feels there will be the same people lining <br />up for both sides stating their opinions. <br /> <br />Mayor Gamec stated that the feedback can be limited and he can request that spokespeople for <br />each side present their case, so the Council does not have to listen to duplicate comments. <br /> <br />Councilmember Look stated that he was invited to a re-creation of the March 1, 2008 event last <br />night. He stated that he went to the neighbor and asked if this was similar to what they recalled <br />hearing during the event and they stated that it was similar. <br /> <br />City Administrator Ulrich arrived at the meeting. <br /> <br />Councilmember Look stated that area kids were really excited about this event and even donated <br />their own shovels and labor to make this event happen. <br /> <br />Mayor Gamec stated that he did not want to debate the issue tonight because the Council was <br />just supposed to decide if a public hearing should be held. <br /> <br />Councilmember Look stated that he feels the work session is the place to discuss this. He stated <br />that if the Council has already decided that it will penalize Diamonds, then there is no reason to <br />hold a public hearing and waste everyone's time.
