City Of Concord, N.H., 2008 WL <br />162521 (1st Cir. 2008) <br /> <br />The 1st U.S. Circuit has jurisdiction over Maine, Massachusetts, <br />New Hampshire, Puerto Rico, and Rhode Island. <br />A city ordinance prohibited Electronic Messaging Centers (EMCs). <br />EMCs are signs that display illuminated text that can change frequently. <br />EMCs may, for example, have electronic text that is scrolling or flashing. <br />The city prohibited the EMCs on the basis that they were detrimental to <br />traffic safety and community aesthetics. <br />Naser Jewelers, Inc. (NJI) sought permission to construct and oper- <br />ate an EMC on the premises of its retail store in the city. NjI claimed <br />that installation of an EMC at another of its stores increased its sales <br />by eighteen percent. The city denied NjI's application because the pro- <br />posed EMC would violate its ordinance. <br />NJI brought a lawsuit against the city.
