CASE #: I

REQUEST FOR SKETCH PLAN REVIEW OF EBONY WOODS;
CASE OF TIM HOLM
By: Tim Gladhill, Management Intern

Background:

Tim Holm submitted a sketch plan to develop three (3) single-family units on the property
located on the east side of Ebony Street N.W., just south of Superbowl. The following items are
enclosed for your information:

a) Site location map
b) Sketch plan .
c) Site Development Plan
d) City Staff review letter dated March 28, 2008

Notification:

No public hearing is required at the sketch plan stage of a plat. However, the City Council
adopted a policy requiring notification of a proposed subdivision be sent out to residents within
350 feet of the subject property during sketch plan submittal. Staff attempted to notify property
owners within 700 feet of the subject property through a variance to lot width request.

Observations:

The subject property is approximately 1.1 acres in size and is zoned R-1 Residential. A
Comprehensive Plan Amendment from Places to Shop to Places to Live, as well as are-zoning
from B-2 Business to R-1 Residential, has already been approved.

The permitted density in the R-1 Residential District is 1-3 units per acre. The sketch plan
proposes 3 units on the 1.1 acres. This equates to a density of 2.72 units per acre, which meets
City Code standards.

The property is located in the Mississippi River Overlay District. The District requirements state
that the project shall preserve 50% of the land as open space and restrict impervious (rooftop and
pavement) to 25% of the lot area (or up to 35% with a Conditional Use Permit). Additionally,
the District requirements state that the minimum lot width for residential parcels shall be 90 feet.
The Sketch Plan indicates that this requirement is not met, and therefore is the subject of a
request for variance to lot width. It is also noted that the maximum structure height in the
Overlay District is 35 feet. If this project goes forward, compliance with the must be verified.
Staff has forwarded the request on to the Minnesota Department of Natural Resources for
comment.

1
