<br />8. That the Subject Property has 244 feet of road frontage which equates to a9% deficiency in <br />overall road frontage to achieve three (3) lots versus two (2). <br /> <br />9. That the Applicant has stated that the rezoning to R-l Residential imposed more stringent <br />performance standards under the Critical River Overlay District that present a hardship or <br />practical difficulty in achieving a reasonable density yield on the Subject Property. <br /> <br />10. That the proposed lots meet the City's standard lot width requirement outside the Critical <br />River Overlay District. <br /> <br />11. That the Subject Property is on the outer limits of the Critical River Overlay District, is not <br />visible from the Mississippi River, and will not adversely impact the scenic qualities of the <br />river corridor. <br /> <br />12. That the variance requested is the minimum variance necessary to accomplish the intended <br />purpose of the Applicant. <br /> <br />13. That the applicant is requesting two (2) eighty foot lot widths and one (1) eighty-four foot lot <br />width as shown on the proposed preliminary plat of Ebony Woods, prepared by Hakanson <br />Anderson Associates, Inc. and dated August 7,2006. <br /> <br />14. That the special conditions causing the undue hardship do/do not result from the actions of <br />the Applicant. <br /> <br />15. That if granted, the variance will/will not grant the Applicant any special privilege that is <br />denied to other owners of lands, structures or buildings in the same district. <br /> <br />16. That if granted, the variance will/will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the R -1 Residential District. <br /> <br />17. That if granted, the variance will/will not violate the intent and purpose of the City's <br />Comprehensive Plan. <br /> <br />18.
