<br />CASE # <br /> <br />PUBLICHEARING <br />REQUEST FOR A VARIANCE TO THE LOT WIDTH REQUIREMENTS IN THE R-l <br />RESIDENTIAL DISTRICT FOR EBONY WOODS; <br />CASE OF TIM HOLM. <br />By: Tim Gladhill, Management Intern <br /> <br />Background: <br /> <br />Ebony Woods has applied for. Sketch Plan review to create three (3) single-family lots in the R-1 <br />Residential District in the Mississippi River Critical Area Overlay District. Minimum lot width <br />for this district for residential parcels is 90'. The lots are proposed to be 80', 80', and 84.5' <br />respectively. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed Sketch Plan <br />c) Response from DNR <br />d) Proposed Findings of Fact <br />e) Proposed Variance <br /> <br />Notification: <br /> <br />State Statute and City Code require that the City attempt to notify property owners within 350 <br />feet of the subject property. Staff attempted to notify property owners within 700 feet of th~ <br />subject property of the request for a variance. <br /> <br />Observations: <br /> <br />City Code establishes a 90-foot lot width for residential parcels in the Mississippi River Critical <br />Area Overlay District. The applicant is requesting a variance to allow for two (2) 80-foot lots and <br />one (1) 84-foot lot. <br /> <br />Staff has forwarded the request on to the DNR, which recommended denial of the request due <br />failure to demonstrate hardship. <br /> <br />The Planning Commission may recall that after significant discussion, the applicant most <br />recently requested to develop six (6) twin-home units (three two-unit structures), which was <br />ultimately denied by the City Council. The original application by Mr. Holm was submitted on <br />April 6, 2006 and was for eight townhome units (two four-unit structures). The applicant was <br />directed several times by City Council to submit revised plans and building elevations. <br /> <br />fA <br /> <br />3 <br />
