Look, being duly sworn on oath deposes and states as follows: <br /> <br />1. <br /> <br />At ail times material herein, I have been a resident of the City of <br />. Ramsey, State of Minnesota. <br />That to the best of my knowledge, Defendant PACT Charter <br />School has been operating in Ramsey, Minnesota since <br />approximately 2004. <br />That I completed and mailed a timely application for kindergarten <br />on behalf of my son for the 2008-09 school year. . I recall that the <br />application form had an explanation and a box to check for the <br />"siblings" preference and proximity preference. Notably. absent <br />was any box on the application for Ramsey residents. <br />That with the exception of the defendant, the City of Ramsey does <br />not have another school within the city limits that serves <br />kindergarten pupil~ or grades 6-12 pupils. <br />That based upon iqformation I received from Ramsey Elementary <br />); , <br />-School, they have not served the kindergarten grade level since <br />approximately 1999 and have never served grades 6-12. <br />That based upon information and belief, defendant has in the years <br />since its move to' Ramsey, adopted an erroneous enrollment policy <br />in contravention of state charter school law contained in M.S. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />-28- <br />
