Based upon information and belief from the <br /> <br />administrator, the plaintiff believes the defendant was not and will not be prepared to <br /> <br />change its current erroneous enrollment policy and/or follow the mandates contained in <br /> <br /> <br />M.S. 124.D. 10 Subd. 9(3) thus damaging the plaintiff's minor son's enrollment <br /> <br /> <br />prospects, other Ramsey kindergarten applicants, and other grades 6-12 applicants. <br /> <br /> <br />"WHEREFORE, the plaintiff prays that the court adjudge the following: <br /> <br /> <br />1. F or a court order and judgment declaring the rights of the parties and <br /> <br />other interpretations of M.S. l24D.lO subd. 9(3). <br /> <br /> <br />2. F or an Order mandating defendant to give enrollment preference to all <br /> <br />Ramsey kindergarten applicants and Ramsey 6-12 applicants that have <br /> <br />made a timely application for the 2008-09 school year. <br /> <br />3. For a court order correcting the past enrollment inequities requiring <br /> <br /> <br />defendant to give a sibling enrollment preference to only those siblings <br /> <br /> <br />who were Ramsey resident kindergarten applicants since 2004 if the <br /> <br /> <br />applications exceeded the available spots. <br /> <br /> <br />4. For a temporary injunction preventing the defendant from holding any <br /> <br /> <br />lotteries that effect kindergarten and grades 6-12 applications until the <br /> <br /> <br />court adjudges the interpretation and ramifications of M.S. 124.D. 10 <br /> <br /> <br />Subd. 9(3). <br /> <br /> <br />5. For an order allowing plaintiff to observe the process of the <br />kindergarten lottery. <br />6. For an order reimbursing plaintiffhis costs, attorney fees, and any other <br /> <br />relief the court deems just and equitable. <br /> <br />-43- <br />
