<br />Board Member Brauer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-10-305 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br />WHEREAS, Daniel Druk, hereinafter referred to as "Permittee," has properly applied for <br />a variance from Section 9.20.22 regarding pavement setbacks from public street right-of-way in <br />the B-2 Highway Business District on the property generally known as 9535 Highway #10 N.W. <br />and legally described as follows: <br /> <br />Lot 2, Block 1, Cowles Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br />WHEREAS, the Board of Adjustment met on October 7, 2004, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from pavement <br />setbacks from public street right-of-way. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />1. Based on Findings of Fact #0701, a variance is hereby granted to the pavement setback <br />from public street right-of-way, as established in Section 9.20.22 of the Ramsey City <br />Code, to install a bituminous surface and concrete curb to within five (5) feet of the <br />property line adjacent to Hwy. 10 or three (3) feet from the existing chain link fence. <br /> <br />2. The. Permittee shall construct the bituminous parking/display area and concrete curb per <br />the approved plan and to the City's specifications. <br /> <br />. 3. That in the event the Subject Property is redeveloped in the future, and if the <br />redevelopment includes reconstruction of the paved areas, then the new pavement <br />surfaces shall be installed in accordance with the then current performance standards <br />established in City Code. <br /> <br />4. The Permittee shall be responsible for all City costs incurred in processing the variance <br />request. <br />
