<br />6. That, on November 16, 2007, the City received the citizen's petition requesting that <br />the EA W be completed, stating the following concerns: <br />a. Noise impacts on sensitive wildlife species <br />b. Soil and groundwater contamination possibilities <br />c. Dust clouds and exhaust emissions <br />d. Increase in traffic <br /> <br />7. That, the Proposal does not meet the EQB thresholds for the completion of a <br />mandatory EA W due to its size. <br /> <br />8. That, in a sound study in Annandale, Minnesota and where similar conditions to the <br />application were found, sound levels from a trail bike track did not exceed noise <br />standards set forth in Minnesota Statutes. <br /> <br />9. That soil and groundwater impacts from the Proposal can be controlled by requiring a <br />stormwater management plan (SWPPP), which will be required as part of the special <br />events permit. <br /> <br />10. That the air quality impacts for the Proposal are projected to remain below the <br />Minnesota Pollution Control Agency's standards because congestion is not expected <br />on local or regional roadways due to these events. <br /> <br />11. That the traffic generated from the Proposal would not exceed the existing traffic <br />levels or exceed the traffic levels generated from additional development, including <br />the regional park. <br /> <br />12. That Mississippi West Park, an Anoka County park with regional designation, is <br />located adjacent to the Subject Property and the Anoka County Parks Department <br />submitted a letter to the City stating that the Proposal would have a "significant <br />negative effect on the public use and enjoyment of the park" and maximizing the <br />"public benefit of the park is dependent upon surrounding land uses must be <br />compatible in nature with the designated uses of the park." <br /> <br />13. That the National Park Service submitted a letter stating that the Proposal would have <br />a negative effect on the public enjoyment of the nearby Mississippi River and would <br />have an adverse effect on the wildlife, including a pair of active breeding eagles <br />associated with the River. <br /> <br />14. That the Subject Property is not located within the Critical River Corridor (MNDNR), <br />the Mississippi National River and Recreation Area (MNRRA-National Park Service <br />unit) or the Wild and Scenic River overlay, although it is adjacent to said areas. <br /> <br />15. That the known eagle's nest is over 1,300 feet from the Subject Property, and that the <br />critical breeding time for eagles is February to May. <br /> <br />RESOLUTION #07-12-334 <br />Page 2 of3 <br />
