Mayor Gamec moved for the adoption of the following resolution: RESOLUTION #07-12-336 A RESOLUTION ADOPTING FINDINGS OF FACT #0818 RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT AMENDMENT TO ALLOW MOTOCROSS, SNOWMOBILE RACING, DEMOLITION DERBY, AND RODEOS WHEREAS, Diamonds Sports Bar & Grill, Inc., hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit Amendment to allow motocross, snowmobile racing, demolition derby, music events, and rodeos on the subject property generally known as 7550 Highway #10, legally described as: Lot 1, Block 1, The Diamonds, Anoka County, Minnesota (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on October 4th, 2007 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That the City Council and Planning Commission held a work session on October 30, 2007 to discuss the applicant's request, discussed the options for a trial period (Interim Use Permit), and directed Staff to conduct a sound trial with regard to motocross racing. 3. The public hearing was continued to November 1,2007, and the minutes of said public hearing are hereby incorporated by reference. 4. That on November 1, 2007 the Planning Commission met, and recommended denial of the Conditional Use Permit, primarily based on the unknown effects the additional sound would have on the area. 5. That the Subject Property is located in the B-2 Highway Business District and is appro~imately 16.6 acres III SIze. 6. That Section 9.20.22 (B-2 Business District) of City Code permits outdoor commercial recreation with the issuance of a conditional use permit. 7. That the Applicant has a current Conditional Use Permit (Resolution #00-03-077) that allows outdoor recreation activities including broomball, softball, and volleyball. 8. That the surrounding parcels to the south and east are part of the Mississippi West Regional Park, the property to the west is zoned B-2 Highway Business, and the property is bounded to the north by Highway #10. 9. That there is approximately 1,100 feet between the nearest residential neighborhood and the proposed outdoor recreational uses.
