<br />complements the character of the surrounding neighborhood, as determined by City <br />Council. <br /> <br />10. That City Code limits construction of telecommunications towers in City-owned parks to <br />those that are adjacent to industrial or commercial uses. <br /> <br />11. That landscaping, intended to screen the tower base and equipment building, will be <br />required and said landscaping is subject to City approval. <br /> <br />12. That the Applicant has stated that there will be no personnel stationed at the site and the <br />base of the Tower will be encompassed by an eight-foot, chain link security fence to <br />prevent unauthorized entry. <br /> <br />13. That the Applicant has stated that access to the Subject Property will be from a <br />bituminous drive aisle to be located off the parking lot, in the location approved per the <br />site plan, and that no parking will be required because site visits will be infrequent and of <br />limited duration. <br /> <br />14. That City Code states that no new tower shall be approved unless the City Council finds <br />that the equipment planned for the proposed tower cannot be accommodated on an <br />existing or approved tower or building within a I-mile radius of the proposed tower for <br />various reasons including insufficient height to reasonably function. <br /> <br />15. That the Applicant has stated that there are no existing buildings or structures in the 1- <br />mile search area of a sufficient height to accommodate the proposed equipment and <br />provide a strong, seamless signal, due to the height of the landfill mound. <br /> <br />16. That City Code requires newly constructed towers to accommodate at least two additional <br />users; the Applicant has stated that the tower design would permit up to three additional <br />users, including the City. <br /> <br />17. That the proposed use will not substantially impair the use or market value of surrounding <br />properties. <br /> <br />18. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />working in the vicinity of the use, or to the public welfare. <br /> <br />19. That the proposed use will not be hazardous or disturbing to existing or future <br />neighboring uses. <br /> <br />20. That the proposed use will be served adequately by essential public facilities and services. <br /> <br />21. That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services and will not be detrimental to the economic welfare of the <br />community. <br /> <br />22. That the proposed use will not involve equipment and conditions of operation that will be <br />detrimental to any persons, property, or the general welfare by reason of excessive <br />production of traffic, noise, smoke, fumes, glare, or odors. <br /> <br />RESOLUTION #08-01-018 <br />Page 2 of3 <br />
