At all times material herein, I have been a resident of the City of . Ramsey, State of Minnesota. That to the best of my knowledge, Defendant PACT Charter School has been operating in Ramsey, Minnesota since approximately 2004. That I completed and mailed atimely application for kindergarten on behalf of my son for the 2008-09 school year.,. I recall that the application form had an explanation and a box to check for the "siblings" preference and proximity preference. Notably. absent waS any box on the application for Ramsey residents. That with the exception of the 'defendant, the City of Ramsey does . not have another school within the city limits that serves kindergarten pupil~ ~+ grades 6- i2 pupils. That based upon iIifprmation I received from Ramsey Elementary -School, they have riot served the kindergarten grade level since approximately 1999 an~ have never served grades 6-12. That based upon information and belief, defendant has in the years since its move to' Ramsey, adopted an erroneous enrollment policy in contravention of state charter school law contained in M.S. 2. 3. 4. 5. 6. -28- -165-
