Following Mr. De Bruyn's failure.to provide me with any <br />documentation. on enrollment, Icontacted the senator in my locale <br />and attorney who requested a legal opinion from the Minnesota <br />Department ofEducation(MDE) on the legitimacy of defendant's <br />contention. . <br />18. On or about January 25, 2008, NIDE weighed in on the <br />interpretation of contained in M.S. 124.D. 10' Subd. 9(3) and <br />rendered an opinioJ? which supported my position. <br />19. Subsequently, on February 11,2008, Imet with Mr. De Bruyn to <br />discuss ramifications of the MDE opinion. Mr~ De Bruyn advised <br />me that he disagreed with the MDE and indicated he would use <br />efforts to reverse the MDE opinion and/or seek an opinion from <br />, the office of the attorney general reversing the decision because it <br />was bad policy that would negatively encourage more enrollment <br />of Ramsey residents'based upon proximity to the scho~l rather than <br />on his vision for the school. <br />20. Based upon information and belief, Mr. De Bruynwas not <br />prepared to change its current erroneous enrollment policy and/or <br />follow the mandates contained in M$. 124.D. 10 Subd. 9(3). <br />21.
