<br />City Engineer Jankowski stated that he feels most of the run off is from the greenhouse and not <br />the road. He estimated that it was 90% from the greenhouses and 10% from the road. <br /> <br />Chairperson Elvig stated that his understanding of the past agreement reached with Mr. Rowe <br />was that the City would work with Mr. Rowe to put a drainage pipe through his property at some <br />location that made sense and that a pond would be dug in back. He stated that the City agreed to <br />stop the storm water utility fees because the plan was to work together and satisfy the drainage <br />concerns. He stated that this plan has not moved forward and noted that the City didn't even <br />know about the pipethat Mr. Rowe placed in the County ditch. <br /> <br />Public Works Director Reimer stated that the pipe was discovered last summer when someone <br />saw the catch basin. <br /> <br />Chairperson Elvig stated that it is clear that the past agreement has not been met and he feels the <br />Public Works Committee needs to make a decision on whether to stick to the original plan or to <br />start over. He stated that he would like to stick with the original plan, but feels a timeframe <br />should be set up. He stated that allowing this to go on for 4 years without Mr. Rowe paying any <br />storm water utility fees was not a prudent way to monitor City funds. <br /> <br />Councilmember Dehen stated that he agreed and feels that Mr. Rowe should pay what everybody <br />else pays and if the ponds are constructed, then he can be credited accordingly. He stated that it <br />would be unfair to others ifthe City created exceptions to the rules. <br /> <br />Mayor Gamec stated that he agreed and these fees or construction of the ponds are just the cost <br />of doing business and Mr. Rowe will need to decide what the best for his business is. He stated <br />that he would like to contact the County about the ditch problems with the road. <br /> <br />Chairperson Elvig stated that he would like to have staff review the possible concerns raised by <br />Mr. Rowe that a pond would drain the neighboring wetland area. <br /> <br />Motion by Councilmember Dehen, seconded by Mayor Gamec, to recommend to the City <br />Council that the appeal from Mr. Rowe be denied and the property be billed at the new rate' of <br />$3,447.96 and the rate can be adjusted based on the credit application. <br /> <br />Motion carried. V oting Yes: Chairperson Elvig, Councilmembers Dehen and Mayor Gamec. <br />Voting No: None. Absent: Councilmember Olson. <br /> <br />City Engineer Jankowski noted that staff will check into the concerns about the pond before the <br />City Council meeting. <br /> <br />Mr. Rowe stated that in the staff memo it was reported that he does not have a fire access road <br />and that has been completed. <br /> <br />Chairperson Elvig asked that staff would also check into this before the City Council meeting. <br /> <br />Public Works CommIttee /January 15, 2008 <br />Page 4 of 13 <br />
