Councilmember Elvig introduced the following resolution and moved for its adoption: RESOLUTION #08-03-058 A RESOLUTION ADOPTING FINDING OF FACT #0822 RELATING TO A REQUEST FROM APRIL MASTELL FOR A HOME OCCUPATION PERMIT TO ESTABLISH AN IN-HOME HAIR SALON ON THE PROPERTY LOCATED AT 6421153rd LANE N.W. WHEREAS, the City of Ramsey received an application from April Mastell for a home occupation permit to operate a hair salon within the dwelling on the property located at 6421 153rd Lane N.W. , legally described as follows: That part of the north 230.35 feet of the south 553.35 feet pf south half of Northeast Quarter of Section 22, Township 32, Range 25 lying east of the west 2466 feet of said south half together with that part of Southwest Quarter of Northwest Quarter of Section 23 said Township and Range described as follows: Beginning at a point 323 feet north of south line of said Quarter Quarter, as measured at right angles and 2699 feet east of west line of south half of Northeast Quarter of said Section 22, as measured at right angles, thence north and pararell with west line of south half of Northeast Quarter of said Section 22 and to a point 553.35 feet north of south line of said Southwest Quarter of Northwest Quarter, as measured at right angel, thence west parallel with south line of said Southwest Quarter of Northwest Quarter and to west line thereof, thence south along west line of said Southwest Quarter of Northwest Quarter to its intersection with a line drawn west from point of beginning and parallel with south line of said Southwest Quarter of Northwest Quarter, thence east parallel with south line of said Southwest Quarter of Northwest Quarter to point of beginning, except road, subject to easement of record, Anoka County, Minnesota. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. That on January 11, 2008, April Mastell, hereinafter referred to as "Applicant", properly applied for a home occupation permit to establish and operate a salon in her home. 2. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.05 of the City Code on March 6, 2008, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Planning Commission recommended approval of the request. 4. That the Subject Property is zoned R-1 Single Family Residential. 5. That the Subject Property is approximately 1.0 acre in size. 6. That hair salons are not a permitted use in the R-l Single Family Residential District.
