<br />he has done research in some surrounding communities and Stock has also gone without <br />inspections 80% of the time in Elk River. <br /> <br />City Attorney Goodrich stated that he feels the Council should make a focused decision on <br />whether helping Mr. Hendriksen would help the City, as a whole. <br /> <br />Councilmember Look stated that he thinks getting involved in this case will "send a shot over the <br />bow" of other contractors that they need to follow the procedures the City has in place. He asked <br />if there was a way for the City to track companies, for example, fictional company, XYZ <br />Roofing Company has pulled "x" number of permits, but never finalized the inspections. He <br />stated that in this example, could the City state that they will not be allowed another permit until <br />the final inspections are completed. <br /> <br />Councilmember Elvig stated that he feels getting involved in this case supports public policy. He <br />stated that he feels residents expect some sort of " big brother" authority to take a look and are <br />relying on the City to make sure things are done correctly. He asked what the cost would be to <br />get involved. <br /> <br />City Attorney Goodrich estimated that the cost would be around $1,000. <br /> <br />Mayor Gamec asked if the City can flag a contractor if there are bad permits or a lack of <br />inspections. <br /> <br />Building Official Kaehler stated that there needs to be just cause. <br /> <br />Councilmember Strommen stated that she likes Councilmember Look's idea about "firing a shot <br />across the bow" that the City expects compliance with its procedures, but her concern is whether <br />this case accomplishes that mission or if it just sets a precedent that the City will have to get <br />involved over and over again in other lawsuits. <br /> <br />Councilmember Dehen stated that he would like City Attorney Goodrich to take a look at the <br />merits of the case for fraud and not just take Mr. Hendriksen's word about this company. <br /> <br />Councilmember Olson stated that she doesn't think it would be a bad idea to support this lawsuit, <br />but also put something in the Ramsey Resident that all contractors need to pull permits and have <br />final inspections with a note that tells homeowners that it would behoove them to make sure that <br />a final inspection is done before a final payment is made. <br /> <br />City Attorney Goodrich stated that he feels it is important to note that the City doesn't know if <br />lack of inspections are what caused damage or if there was major damage in this case. He stated <br />that this is a statement that has been made by Mr. Hendriksen and the City is not concluding this, <br />but that the City thinks inspections are a good idea. <br /> <br />Mr. Hendriksen stated that he was hoping the Council could give the authority to City Attorney <br />Goodrich to sign off on this brief similar to the way they do for Development Agreements.
